In this Privacy Policy, 'us', 'we' or 'our' means Aussite (ABN: 52 202 079 312). We are committed to respecting your privacy. Our Privacy Policy sets out how we collect, use, store and disclose your personal information. We are bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act).

By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us. We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.

Personal information includes information or an opinion about an individual that is reasonably identifiable. For example, this may include your name, age, gender, postcode and contact details. It may also include financial information if necessary for service engagement.

1. What kinds of personal information do we collect?

We may collect the following types of personal information:

  • name;
  • mailing or street address;
  • email address;
  • telephone number and other contact details;
  • company name and job title;
  • age or date of birth (if relevant for a specific service or legal requirement);
  • information relating to your business or project requirements if you enquire about or engage our services;
  • details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;
  • your device ID, device type, geo-location information (if you permit this), computer and connection information, statistics on page views, traffic to and from our website, ad data, IP address and standard web log information, collected through your use of our website;
  • any additional information relating to you that you provide to us directly through our website or indirectly through your use of our website or online presence, or through other websites or accounts from which you permit us to collect information;
  • information you provide to us through customer surveys or feedback; or
  • if you apply for a job or position with us, information related to your application (see section 2).

We generally do not collect sensitive information (as defined in the Privacy Act), such as information about your health, race, ethnic origin, or political opinions, unless it is directly relevant to our service provision and you consent, or we are required or authorised by law to do so.

2. How do we collect your personal information?

We may collect these types of personal information either directly from you, or from third parties. We may collect this information when you:

  • contact us through our website, via email, or by telephone;
  • enquire about or engage our services (e.g., for web development, app development, AI integration);
  • register for an account on our website (if applicable);
  • subscribe to our newsletters or marketing communications (if applicable);
  • communicate with us through correspondence, chats, or when you share information with us from other social applications, services or websites;
  • interact with our website, services, content and advertising; or
  • invest in our business or enquire as to a potential purchase in our business.

In addition, when you apply for a job or position with us, we may collect certain information from you (including your name, contact details, working history and relevant records checks) from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract.

We endeavour to collect your information directly from you. However, in some circumstances, we may collect your information from third parties, such as your employer (if they are engaging our services on your behalf), publicly available records, or our business partners.

3. Why do we collect, hold, use and disclose personal information?

We may collect, hold, use and disclose your personal information for the following purposes:

  • to enable you to access and use our website and services;
  • to provide you with our web development, app development, AI integration, and other related services;
  • to communicate with you, including responding to your enquiries and providing customer support;
  • to operate, protect, improve and optimise our website, services, business and our users' experience, such as to perform analytics, conduct research and for advertising and marketing relevant to our services;
  • to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
  • to send you marketing and promotional messages and other information that may be of interest to you about Aussite's services, including information sent by, or on behalf of, our business partners that we think you may find interesting (you can opt-out of marketing communications – see section 4);
  • to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners (if applicable);
  • as part of a sale or transfer of assets or other corporate transaction involving Aussite;
  • to comply with our legal obligations (including those under the Australian Consumer Law), resolve any disputes that we may have with any of our users or clients, and enforce our agreements (such as our Master Service Agreement and Statements of Work) with third parties and clients; and
  • to consider your employment application.

We may also disclose your personal information to a trusted third party who also holds other information about you. This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the products and services that you receive. This will always be done in compliance with privacy laws.

4. Do we use your personal information for direct marketing?

We may send you direct marketing communications and information about our services that we consider may be of interest to you. These communications may be sent in various forms, including mail, SMS, fax and email, in accordance with applicable marketing laws, such as the Spam Act 2003 (Cth). If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

In addition, at any time you may opt-out of receiving marketing communications from us by contacting us (see details below) or by using opt-out facilities provided in the marketing communications and we will then ensure that your name is removed from our marketing list.

We do not provide your personal information to other organisations for the purposes of direct marketing unless expressly authorised by you.

5. To whom do we disclose your personal information?

We may disclose your personal information for the purposes described in this privacy policy to:

  • our employees and related bodies corporate;
  • third party suppliers and service providers (including providers for the operation of our websites and/or our business or in connection with providing our products and services to you, such as IT systems administrators, mailing houses, couriers, payment processors, data entry service providers, web hosting providers, and providers of cloud storage);
  • professional advisers (such as lawyers, accountants, and business advisors), dealers and agents;
  • payment systems operators (e.g., merchants receiving card payments, if applicable);
  • our existing or potential agents, business partners or partners;
  • our sponsors or promoters of any competition that we conduct via our services (if applicable);
  • anyone to whom our assets or businesses (or any part of them) are transferred;
  • specific third parties authorised by you to receive information held by us; and/or
  • other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.

6. Disclosure of personal information outside Australia

We may disclose personal information to third-party suppliers, service providers, and, on rare occasions, contractors located overseas for some of the purposes listed above. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

We may disclose your personal information to entities located outside of Australia. The countries in which these recipients may be located can vary depending on the services and systems we use, but may include, for example:

  • Countries where major cloud service providers and data hosting facilities are located, such as the United States, Singapore, Ireland, and other countries in the European Economic Area.
  • Countries where our payment processing providers may be located, which commonly includes the United States.
  • On rare occasions, if we engage overseas contractors for specific project components, the countries where such contractors are located.

We will update this policy if we become aware of regular disclosures to specific countries not listed.

By providing your personal information to us, you consent to the disclosure of your information outside of Australia on this basis. You acknowledge that if an overseas recipient handles your personal information in a way that breaches the Australian Privacy Principles, we may not be accountable under the Privacy Act for that breach if you have consented to the disclosure and we have informed you that APP 8.1 will not apply. However, we will, where practicable and reasonable, continue to take steps to ensure that any overseas recipient deals with such personal information in a manner consistent with the Australian Privacy Principles.

7. Using our website and cookies

We may collect personal information about you when you use and access our website. While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol (IP) address assigned to your computer.

We may also use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, TV, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser but our websites may not work as intended for you if you do so.

The information collected by cookies may be used to improve our website, for statistical, marketing and website-customisation purposes, and to help us provide a better user experience. Where cookies collect your personal information, that information will be handled in accordance with this Privacy Policy.

We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your personal information. For example, we store electronic data on secure servers and may use measures such as encryption, firewalls, and access controls where appropriate. However, we cannot guarantee the security of your personal information.

Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites. The privacy policies that apply to those other websites may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites.

10. Accessing or correcting your personal information

You can access the personal information we hold about you by contacting us using the contact details below. Sometimes, we may not be able to provide you with access to all of your personal information and, where this is the case, we will tell you why. We may also need to verify your identity when you request your personal information. There may be a reasonable charge for providing access to personal information.

If you think that any personal information we hold about you is inaccurate, incomplete, or out of date, please contact us and we will take reasonable steps to ensure that it is corrected.

If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your personal information, you can contact us using the details set out below. Please include your name, email address and/or telephone number and clearly describe your complaint. We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time (usually within 30 days).

If you think that we have failed to resolve the complaint satisfactorily, we will provide you with information about the further steps you can take, including contacting the Office of the Australian Information Commissioner (OAIC).
